  Note: (i) Participants are not required to purchase the product in order to enter into the draw. (ii)  Nestlé may monitor Submission and that this will be taken down if (a) it infringes third-party intellectual property rights; (b) is defamatory; (c) irrelevant or not linked in any way to the Activation; or (d) otherwise unlawful.   Assignment of Rights: 1)      By Participation in this Activation, the Participant hereby unconditionally authorizes, grants, assigns and transfers the exclusive, worldwide, perpetual and irrevocable rights (material, moral, copyright), title and interests and other proprietary rights of all and any nature whatsoever in the Submission to Nestlé Middle East FZE Société des Produits Nestlé S.A. and/or its subsidiaries and affiliated companies (hereinafter collectively referred to as “Nestlé Group”).  2)      By virtue of this transfer/assignment of rights, Nestlé shall have the full right and authority, including without limitation to: a.       use, broadcast, distribute, publicly present and publish the Submission on all websites owned and/or operated by Nestlé and other distribution channels of any kind now known or hereafter devised; all communications both external and internal, commercially use and place the same on Nestlé packaging and/or getups, display on the premises of Nestlé, combine the photos with the media, banners, advertisements and publications (including but not limited to newspapers, magazines, billboards, leaflets, posters, websites, banners, truck-backs) relating to any and/or all Nestlé products and brands; b.       transfer the intellectual property rights and all other proprietary rights to any third party and/or for use in any and all ways that Nestlé deem fit. 3)      Participants hereby confirm that he/she has obtained all authorization, clearances and releases from all the persons appearing in the Submission.     Data privacy 1.)    Nestlé will be collecting personal information of the Participants in accordance with its Privacy Policy  2.)    Nestlé will collect personal information in order to conduct the Activation and may, for this purpose, disclose such information to third parties, including, but not limited to, Nestlé’s authorized agents and as required, to regulatory authorities. 3.)    By participating in the Activation, the Participant hereby consents to the use of their personal information in the manner as set out in these Terms and Conditions and waives their rights to initiate any claim against Nestlé for privacy invasion, improper disclosure of personal information or any other related claims.   Selection of winner: 1.       Two (2) winners will be selected through a draw which will occur on the 22nd of December 2021. Please note, these dates are a guide and subject to change without prior notice. 2.       The draw system is an automated system, which will randomly select 2 winners with the presence of the COC representative. 3.       The winner/s will be notified through phone and/or email by Nestlé or its authorized representative. If Nestlé cannot contact the winner/s for any reason, within 30 days after the announcement of winner/s, Nestlé reserves the right to award the prize to another winner/s. If Nestlé cannot contact the winner/s on the phone or email address provided for any reason, or the winner does not claim their prize within sixty (60) days after the announcement of winner/s, Nestlé reserves the right disqualify that winner and to reallocate the prize to a winner selected in the same manner. 4.       Where required by Nestlé, the chosen Participant and any person sharing the prize shall be required to complete official release forms, have a copy of their passport/ID taken and a photograph taken of them receiving the prize, prior to the official receipt of the relevant prize(s), failing which Nestlé reserves the right to forfeit the prize as it deems fit or as required by law. 5.       The winner/s will be required to provide proof of identity and address in the form reasonably required by Nestlé. Nestlé shall not be compelled to award the prize to the winner/s if they cannot provide any proof of identity. 6.       The prize cannot be exchanged for cash or any other alternative form of compensation. Nestlé reserves the right to substitute any prize for another prize of equal or greater value or alter the dynamics of a prize if it is no longer available or due to any unforeseen circumstances without prior notice. All prizes are non-transferable. 7.       In the event that the winner/s opts not to accept their prize or was not able to receive the prize for reasons mentioned in these Terms and Conditions, the relevant prize will be deemed forfeited and Nestlé may, subject to applicable laws, award the prize to another winner/s. 8.       Nestlé decision regarding the award of the prize and/or in other issues not covered by these Terms and Conditions, shall be final and binding on all Participants, and no queries, challenges or appeals may be made or entertained. 9.        Any person attempting to defraud in any way by falsely claiming to be the winner or falsifying any proof of identity will be ineligible for the prize and may be prosecuted to the full extent of the law.   Prizes: Each winner will receive a signed football t-shirt from Mohamed Salah   Disclaimer: in the event that the player is unavailable, an alternative option will be given to the winner.   General Terms: 1.       By entering this Activation, the Participants warrant that they have read and agree to abide by these Terms and Conditions. 2.       If for any reason this Activation is not capable of being carried on as planned, due to tampering, unauthorized intervention, fraud, technical failure, act of God, war (whether or not declared), political coup or insurrection, rebellion, labor dispute, fire, epidemic, storm, flood, typhoon, explosion, legal enactment, government directive, order or regulation, any law or regulation having force of law or any other reason or cause beyond the control of Nestlé, which corrupts or affects the administration security, fairness or integrity or proper conduct of this Activation, Nestlé, to the fullest extent permitted by law, reserves the right in its sole discretion to cancel, terminate, modify or suspend this Activation and to disqualify any Participant who tampers with the Activation and/or the entry process. 3.       Nestlé will be entitled at its sole discretion and subject to any applicable law, to cancel, terminate, extend or suspend the Activation or to modify these Terms and Conditions at any time prior to the closing date. 4.       Nestlé shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any death or personal injury suffered or sustained as a consequence of participation in the Activation, except for any liability which cannot be excluded by law. 5.       Participant, to the fullest extent permitted by law, hereby releases Nestlé, and all persons or corporations associated directly or indirectly with the Activation from any and/or all claims, demands and proceedings whatsoever arising out of: a.       their participation in the Activation; b.       any breach of these Terms and Conditions; 6.       This release and indemnity extend to and includes Nestlé, its parent company and its related bodies corporate, and its respective directors, officers, agents, contractors, employees and sponsors associated with or which is involved directly or indirectly with the Activation. Terms and Conditions (eCopon):
01 - The purchase is not required to enter the competition.
02 - The conditions of the competition are subject to the laws and regulations in force in the Kingdom of Saudi Arabia.
03 - Chambers of Commerce employees and their first-degree families are not entitled to participate in competitions.
04 - Employees of the operating company and their first-degree families are not entitled to participate in competitions.
05 - Advertising and publicity agency employees and their first-degree families are not entitled to participate in competitions.
06 - The employees of the company that owns the competition and their families of the first degree are not entitled to participate in the competition related to it.
07 - The employees of the participating malls and their families of the first degree are not entitled to participate in the respective competition.
08 - The name must be identical to the legal identity in force in the Kingdom of Saudi Arabia.
09 - If it is found that there is more than one account for one person, all accounts will be canceled without exception, including the main account, in order to demonstrate his circumvention of the systems, and he will be deprived of all the prizes he won under these accounts.
10 - For residents of the Kingdom of Saudi Arabia, write the full name in Arabic as it is found in the regular identity (national ID, resident ID).
11 - All winners must have a valid ID upon receiving the prize.
12 - Changing an account information that has participated in a contest that has not yet been drawn, will deprive its owner of winning even if he wins.
13 - In the event that the name of the winner does not match the name on the official ID approved in the Kingdom of Saudi Arabia, it will be disqualified and the drawing will be re-drawn again.
14 - If the winner's name and mobile number do not match the data registered in the system (eCopon), he will be excluded and the draw will be repeated again.
15 - Reading (award receipt card) created from the (eCopon) system by the competition organizing company is considered an acknowledgment by the winner of receiving the award.
16 - The Smart Link Information Technology Co., Ltd. (eCopon) has the right to file a fraud case against people who filled out the acknowledgment form with incorrect data that does not match the legal identity (national ID, resident ID).
17 - Entering the competition is an implied acceptance of its terms and conditions.
18 - The Smart Link Information Technology Co., Ltd. (eCopon) is the operator of the competition system only. It has no authority over the type or quantity of prizes, delivery or exchange of prizes, but this is done by the company, sponsor or organizer of the competition.
19 - Smart Link Information Technology Co., Ltd. (eCopon) is an operator of the competition system only, and has no relationship in the event that one of the parties breaches any of the terms of receiving (the winner) or delivering (the facility) the prize.
20 - Apple is not responsible for any of these competitions that are present in the eCopon system and application, and it has nothing to do in any way with these competitions.
