All participants to this Activation (“Participants”) shall be subject to these Terms and ConditionsActivation DatesThis Activation will run from:23 august to 23 September 2020Entrance to the ActivationParticipants must be:1.    18 years old and above; and has at least a child in school2.    legal residents of KSA.Mechanics:1.     Scan the QR code for Nestlé products (cornflakes: Country Corn Flakes) on the display stands that you can find in stores. 2.     Click the link on our social media posts (Facebook Instagram) and at the end of digital ads (YouTube or Shahid) and answer the questions about “wholegrain” to be eligible to participate in the draw. Note: Participants are not required to purchase the product in order to enter into the draw.Data Privacy1.     Participants will be required to submit their personal details such as name, phone number, email, country and must agree to the Terms and Conditions. 2.     Nestlé will be collecting personal information of the Participants in accordance with its Privacy Policy (https://www.nestle-family.com/english/privacy.aspx). By participating, the Participant hereby confirms and consents to the use of cookies.  3.     Nestlé will collect personal information in order to conduct the Activation and may, for this purpose, disclose such information to other Nestlé companies outside the Middle East and third parties, including, but not limited to, Nestlé’s authorized agents and as required, to regulatory authorities.4.     By participating in the Activation, the Participant hereby consents to the use of their personal information in the manner as set out in these Terms and Conditions and waives their rights to initiate any claim against Nestlé for privacy invasion, improper disclosure of personal information or any other related claims.Selection of Winner1.     Six (6) winners will be chosen through a raffle draw. From within the Kingdom. Two (2) winners will be selected from each region within five (5) working days after end of activation. 2.     Winners will be contacted through their Facebook account and/or via mobile number. If Nestlé cannot contact the winner/s for any reason, within (10) days after the announcement of winner/s, Nestlé reserves the right to coordinate with the competent authorities to award the prize to other winner/s. 3.     The winner/s will be required to provide proof of identity in the form reasonably required by Nestlé. Nestlé shall not be compelled to award the prize to the winner/s if he/she cannot provide any proof of identity.4.     Prize/s of the competition cannot be exchanged for cash or any other items. Nestlé reserves the right to substitute any prize for another prize of similar value or alter the dynamics of the prizes due to any unforeseen circumstances without prior notice. All prizes are non-transferable.5.     In the event that the winner/s opts not to accept his/her prize or was not able to receive the prize for reasons mentioned in these Terms and Conditions, the relevant prize will be deemed forfeited and Nestlé may, subject to applicable laws, and with the coordination of the competent authorities to award the prize to another winner/s.6.     Employees of Nestlé, its subsidiaries, divisions, affiliates, authorized dealers/distributors, agents and their immediate family members are not eligible to join in this Activation. Nestlé reserves the right to disqualify any such person from receipt of any prize and/or require the return of any prizes awarded. In such an event, and subject to any legal requirement, Nestlé reserves the right to select a new winner with the coordination of the competent authorities to draw for different winners for the prize and/or dispose of the prize in any manner it deems fit, in its sole discretion.   7.     Nestlé’s decision regarding the award of the prize and/or in other issues not covered by these Terms and Conditions, shall be final and binding on all Participants, and no queries, challenges or appeals may be made or entertained for its decision.  8.     Any person attempting to defraud Nestlé in any way by falsely claiming to be the winner or falsifying any proof of identity will be ineligible for the prize and may be prosecuted to the full extent of the law. PrizesEach winner will receive the following prize (according to country):Kingdom of Saudi Arabia:  School tuition fees for one child with a value of 20,000 SAR General Terms1.     By entering this Activation Participants warrant that they have read and agree to abide by these Terms and Conditions.2.     If for any reason this Activation is not capable of being carried on as planned, due to without limitation infection by any computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, act of God, war (whether or not declared), political coup or insurrection, rebellion, labor dispute, fire, epidemic, storm, flood, typhoon, explosion, legal enactment, government directive, order or regulation, any law or regulation having force of law or any other reason or cause beyond the control of Nestlé, which corrupts or affects the administration security, fairness or integrity or proper conduct of this Activation, Nestlé, to the fullest extent permitted by law, reserves the right in its sole discretion to cancel, terminate, modify or suspend this Activation and to disqualify any Participant who tampers with the Activation and/or the entry process.3.     To the fullest extent permitted by law, Nestlé is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer software and/or equipment, failure of any e-mail account or any combination thereof. 4.     Nestlé will be entitled at its sole discretion and subject to any applicable law, to cancel, terminate, extend or suspend the Activation or to modify these Terms and Conditions at any time prior to the closing date. 5.     Nestlé shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any death or personal injury suffered or sustained as a consequence of participation in the Activation, except for any liability which cannot be excluded by law.  6.     Participant, to the fullest extent permitted by law, hereby releases Nestlé, and all persons or corporations associated directly or indirectly with the Activation from any and/or all claims, demands and proceedings whatsoever arising out of:(a)   their participation in the Activation;(b)   any breach of these Terms and Conditions;(c)    non-receipt of the prize due to force majeure;(d)   use of the prize;(e)   non-issuance of visa; and/or 7.     This release and indemnity extend to and includes Nestlé, its parent company and its related bodies corporate, and its respective directors, officers, agents, contractors, employees and sponsors associated with or which is involved directly or indirectly with the Activation. (eCopon) has the right to file a case that circumvents the persons who filled out the Endorsements form with incorrect data that does not match the regular identity (National identity, Gulf identity, resident identity, visitor ID, passport).20- Entering the competition is an implicit approval of its terms and conditions.21- Smart Match for IT LLC. (eCopon) is a company that operates for the competition system only, it has no authority over the type or quantity of prizes or their delivery or exchange, but this is done by the company or the sponsor of the competition or organized for it.22- Smart Match for IT LLC. (eCopon) is a company that operates for the competition system only, it has no relationship if one of the parties violates any of the terms of the (winner) receipt or delivery (Company) of the award.23- Apple is not responsible for any of these competitions found in the system and application of eCopon, and it has no relationship whatsoever with these contests.
Terms and Conditions (eCopon):
01 - The purchase is not required to enter the competition.
02 - The conditions of the competition are subject to the laws and regulations in force in the Kingdom of Saudi Arabia.
03 - Chambers of Commerce employees and their first-degree families are not entitled to participate in competitions.
04 - Employees of the operating company and their first-degree families are not entitled to participate in competitions.
05 - Advertising and publicity agency employees and their first-degree families are not entitled to participate in competitions.
06 - The employees of the company that owns the competition and their families of the first degree are not entitled to participate in the competition related to it.
07 - The employees of the participating malls and their families of the first degree are not entitled to participate in the respective competition.
08 - The name must be identical to the legal identity in force in the Kingdom of Saudi Arabia.
09 - If it is found that there is more than one account for one person, all accounts will be canceled without exception, including the main account, in order to demonstrate his circumvention of the systems, and he will be deprived of all the prizes he won under these accounts.
10 - For residents of the Kingdom of Saudi Arabia, write the full name in Arabic as it is found in the regular identity (national ID, resident ID).
11 - All winners must have a valid ID upon receiving the prize.
12 - Changing an account information that has participated in a contest that has not yet been drawn, will deprive its owner of winning even if he wins.
13 - In the event that the name of the winner does not match the name on the official ID approved in the Kingdom of Saudi Arabia, it will be disqualified and the drawing will be re-drawn again.
14 - If the winner's name and mobile number do not match the data registered in the system (eCopon), he will be excluded and the draw will be repeated again.
15 - Reading (award receipt card) created from the (eCopon) system by the competition organizing company is considered an acknowledgment by the winner of receiving the award.
16 - The Smart Link Information Technology Co., Ltd. (eCopon) has the right to file a fraud case against people who filled out the acknowledgment form with incorrect data that does not match the legal identity (national ID, resident ID).
17 - Entering the competition is an implied acceptance of its terms and conditions.
18 - The Smart Link Information Technology Co., Ltd. (eCopon) is the operator of the competition system only. It has no authority over the type or quantity of prizes, delivery or exchange of prizes, but this is done by the company, sponsor or organizer of the competition.
19 - Smart Link Information Technology Co., Ltd. (eCopon) is an operator of the competition system only, and has no relationship in the event that one of the parties breaches any of the terms of receiving (the winner) or delivering (the facility) the prize.
20 - Apple is not responsible for any of these competitions that are present in the eCopon system and application, and it has nothing to do in any way with these competitions.
